Music licensing is intended to ensure that the creators of musical works get paid for their work. A purchaser of recorded music owns the media on which the music is stored, not the music itself. A purchaser has limited rights to use and reproduce the recorded work.

DEFENITIONS

The following words and phrases appear in discussion of music licensing:

license
the right, granted by the copyright holder, for a given person or entity to broadcast, recreate, perform, or listen to a recorded copy of a copyrighted work

licensor
the owner of the licensed work

licensee
the person or entity to whom the work is licensed

performance
for the purposes of this article, the live performance of a musical piece, regardless of whether it's performed by the original artist or in the manner it is best known

broadcast
the replaying of pre-recorded works to multiple listeners through various media or in a 'semi-live' setting such as a bar or bookstore, and including radio, TV, webcasting, podcasting, etc. (Note: Using this definition and the previous one, you find the information that leads to phrases like 'live broadcast performance'.)

performing rights organization
large companies, the best-known of whom are ASCAP, BMI, and to a lesser extent SESAC (there are others as well) whose fundamental job it is to keep track of every single performance or broadcast of all works protected under copyright. A more in-depth analysis of how these organizations work will be threaded throughout the body of this article

pre-cleared music
music that has been pre-negotiated for price, distribution and legal use, generally through licensing for film, video, television (commercials and programs), Internet, events, video games and multimedia productions.

copyright
literally, 'the right to copy.' Prior to 1886, no effective international law of copyright existed. The first major international copyright law conventions were the Berne Convention for the Protection of Literary and Artistic Works created in 1886. It is not within the scope of this document to examine the various changes, additions, and ancillary agreements to the Berne Convention.

synchronization licensing
the licensing of musical works to be synchronized with moving pictures as background in a motion picture, television program, video, DVD, etc.
master use licensing
the licensing of the recording of a musical work to be performed as a soundtrack, bumper, lead-in or background to a motion picture.

publisher
for the purposes of copyright, a publisher is the owner of the copyrighted work. It is now standard practice for songwriters of even the slightest prominence to form a 'publishing company' who actually owns the rights to their work; the reasons for this are matters of legal finery and largely not of value to the scope of this article. This phrasing is reflective of the state of media at the time of the Berne Convention, when all music distribution was done on paper as sheet music (or player piano rolls).

NEED HELP WITH LICENSING?

Contact: Magnus Palmborg of Music Supervision company music super circus

Fredrik Davidssons portfolio sajt

Check out Director Fredrik Davidssons new site

Miller, are breaking new ground. Theirs is a bellwether case: The first of thousands of cases awaiting trial in Nicaragua and the first legal case where foreign farm workers were allowed to testify against an American multinational corporation before a full jury on U.S. soil. At stake are the futures of generations of workers, their families as well as the culture of global, multinational business.

Check out the Bananas* movie site

Music Super Circus Show Reel

Check out Music Super Circus Music Supervision and Music Production showreel

Vill du bli min nya kollega?

SVT interaktiv rekryterar webbutvecklare

SVT:s vision är att göra Fri television i världsklass och att vara den främsta arenan för kvalificerade och kreativa medarbetare här i Sverige. De distribution seems to be working very well. I sit in Nicaragua on a 256 cable modem...

But, they have on of the worst Interaction Designs I have ever seen in the application. It's very, very hard to find any good content.

I posted this to their suggestion forum:
I Love the project but you clearly have a whole lot of work to put in in terms of Interaction Design for Channel/Program browsing and search. It's already very hard to find content I'm interested in viewing, this will only get worse as more content is added.

Right now everything is based on browsing by channels... Channels that I don't know or care about. I want to find good content. I don't care what channel is providing it!

An EPG complemented by some user defined taxonomy and trend patterns might do the trick... Previews and/or multiple stillframes are also needed.

Maybe you already have some really good (and revolutionary) ideas in the pipe. Lets hope so, because when we move out from the scheduled Broadcast TV world on fixed channels the key to success will be content availability.

Also. Different types of content will need to be found in different ways... The KERNEL32.DLL file handles memory management, input/output operations, and interrupts.

I was unable to recreate the error on any test machine but with som help from visitors I managed to narrow it down to the prototype.js library. We directed them to some others sites using the library and shure enough, those sites were chrashing as well!

I really need to keep prototype or else I have to refactor massive ammounts of code! But it's really hard trying to find what part of prototype causes these crashes when I cant recreate it myself! And I cant find any information about this problem when googling for it!

Note: The site have had more than 2 million unique visitors sense we implemented the Prototype JavaScript Framework and only 6 visitors have reprted problems!

If someone has heard of this before. Please leave a comment!!!

My lead right now: [Rails-spinoffs] Re: IE 6 SP1 crashes on pages with Scriptaculous - SOLVED

OK. It is a Browser Helper Object BHO found in some Dictionary software that triggers the crash! Cambridge Advanced Learner's Dictionary and the Oxford Advanced Genie have this plugin (that translates words on the page) made by the Danish company textWare (that don't seem to exist anymore). Removing the BHO or simply disabling third-party browser extenstions does the trick.

But I'm not satisfied with this, I really don't want to build sites on top of a framework that can crash the entire browser, even though that only happens with some perhaps very badly written BHOs. I still have a hard time reproducing the error myself, hopefully I can contact some visitor that experieced it again and find out exactly at what line i prototype it occurs!

Amazon Web Services

"Amazon is starting to rent out just about everything it uses to run its own business, from rack space in its 10 million square feet of warehouses worldwide to spare computing capacity on its thousands of servers, data storage on its disk drives, and even some of the millions of lines of software code it has written to coordinate all that." - Business Week: Jeff Bezos' Risky Bet

Actually Quite fantastic services to use for small projects and companies that need reliable solutions that can scale to the infinite! It seems to work quite well! The company behind the Site, Riya, had a search product for face recognition... not quite as profitable as this shopping search tool has the potential to be!

The real interesting bit is when you can search for products that look LIKE products worn by celebrities! On the site right now there's just a few examples but the word is that in the future you will be able to upload your own pictures.
Celebrities will get even more sponsored clothes and jewellry in the future!!!

Who will buy the company?
Yahoo really ought to! I start by defining a paragraph and parse two or more newlines to end it and create a new paragraph. The Editors are allowed to put a picture with caption, a quote block, a fact box etc. wherever they want in the body text (and have been doing so in tens of thousands of articles that I have to keep).

Nesting a <div> inside a <p> ... </p> is not valid and I cant't force the image, qoute, factbox... to be placed outside the paragraph. The only easy solution I want to use is to put the elemts inside a inline-element such as a span, making it valid, but redefine the span to display: block;

<style type="text/css">
.float {
display: block;
float: right;
}
</style>

<p>
Lorem ipsum dolor sit amet, consectetuer adipiscing
elit. Nunc orci
<span class="float"><img src="lorem.jpg" width="100" height="150" border="0" alt="alttext" />
<br />Caption
</span>
lacus, rutrum eu, elementum quis, rhoncus iaculis, risus.
Pellentesque habitant morbi tristique senectus et netus
et malesuada fames ac turpis egestas.
</p>

Is fooling the validator like this OK? Or am I terrorising the quest for a valid marked-up internet! I think it's for a good cause. The Image in this example is inline, inside a pargraph where it actually belongs if that's where the Editor put it. The blockifying done with CSS is just for layout purposes!

Useful apps

Creativyst: JavaScript Compressor, CSV to XML Converter, CSV to JavaScript, JavaScript Sandbox, Outlook to DCEvents.js

mafriedman: Web-based Javascript IDE

JSMin: The JavaScript Minifier

Ajax Toolkits

Interesting Open Source projects to make AJAX and XMLHttpRequest easy:
Dojo Toolkit
DWR - Direct Web Remoting
JSON-RPC-Java
Haven't had time to evalute and compare these projects. Some example words are listed but when I try them I don't see any images or references to the image search. Maybe it's regional, I get the .se domain.

It would be nice though to be able to do simultaneous searches for Web, Images, Groups, News and Froggle on Google like on A9. On A9 you can also search simultaneously in the Yellow Pages and what's really cool are the Street level photos... Google’s biggest advantage has always been it's simplicity but now I'm turning more and more to A9. I even traded my Google bar for the A9 bar in Firefox. It's a time saver to use it. History and Simultaneous searches... but unfortunately no Groups... I would rather see Google implement features like these though. First of all because they would probably make it even better and second of all A9 is owned by Amazon and put up A9 to sell more on their online store (and Google is a Time-Warner company now I heard)...

User specified Google AdSense Ads. Is it useful?

I love Google, we all love Google. We love Google Labs, Gmail and the AdSense program (cuz - In theory - we make money on our Blogs) but I have some thoughts (not doubts) about some issues.

Google is currently Beta Testing a new AdSense function that allows the user to specify a subject of interest See it here on the left is a "skyscraper" block with the feature. Ok that's really Cool. I can choose to see ads about other related subjects... after the first click I can even specify whatever subject I want to see ads about. And that's when I start questioning it! Some discussions about this I've seen have emphasized on the control needed by the webmaster from their AdSense admin area. See Google Testing True User-Specified Ads.

Many others have been more positive:

"This is a just unbelievable idea. Google is truly pushing the idea that its ads are more than just ads, they're useful, and I commend it."

My biggest question and concern is if it's useful. Unless the personalization goes further this feature is cool but useless! Just like the Google Suggest! Because if I'm to interested in "Personal injury claims" and "Claims Court" and want to now more about lets say "Auto Insurance" I would probably Google for it ... not navigate in a little ad Space...

But both "choose youre ad" and Google suggest could be very useful if they where merged with the Google Labs Personalized Search project and perhaps also with some logging of people’s history of searches... Like A9 Search. But now we are in deep, dark waters when it comes to internet privacy. But let’s not think about that for a minute. Google suggest was only a cool feature testing the XmlHTPPRequest object. But combined with personalization it can be a wonderful feature, just like Gmail's auto completion of addresses. I think this is even truer for the Choose Your Ad feature. If the Ads (and suggested other topics) were chosen by a mix of the page content and my personalized preferences and history they would potentially be dynamite effective...

The good people at Google have probably already thought about this and they can’t close their eyes for the privacy problems, third party cookies and Microsoft’s wish to block them out.

External Related Links:
User specified ads in action!
Google Labs Personalized Search
A9 Search - Remember what you’ve seen—and when!
Microsoft Aims to Block AdSense
Google's innovations are popular and effective. Large advertisers can use it for their complex ad management needs, like tying product margins to optimized keyword bids. Third parties can use the API to build new interfaces to manage their client accounts. Best of all, an API enables the creation of all sorts of unanticipated ideas. In our experience, it's better to wear "Not Invented Here" as a badge of honor than as a chip on your shoulder. Should be possible to automate with a little/lot of work.

As for rivavx this is defintely a way to expand their product by taking the sound indirectly from the flv and merging it with video format that you want. Support for this type of merging is availible in ffmpeg so it's really a matter of waiting to see if they can make a product of it.

-----

It seems like the war is lost. However, there is currently
> no way to extract or convert FLV files into any other audio format.
>
> Thanks
> Brandon

quote: meowmeow70

We decide fold our solution based on macromedia FCS due to above reason. Stay away from FLV as much as we can.

quote: dlorenso

We contacted Sorenson regarding the NellyMoser codec to see if they'd sell us the decoder. Response was something along the lines of several thousand dollars plus restrictions that required profit sharing and/or more thousands. In addition, we would be unable to share the technology we build or make available as a service online...
...Perhaps we can ditch the FCS server soon too...
...Wouldn't it be great if macromedia could adopt formats like MPEG and MP3 into the FCS product? I'd pay for that. Meanwhile ... FLV ... come on Macromedia, open it up, gimme the tools, or it's useless.

It's like I was told from start. It's not a bug it's a feature... But we spent alot on the Flash Com Server and we have an flash webcam app that works very well. So we will try one more thing! My colleague Frank will create a drop folder on our MacOSX server and use Apple script to open the FLV in Flash MX and then export a SWF that I can convert to other formats...

The Video Kiosk on svt.se/faktum (in swedish).

-------------------------------------------------------------------------------
EARLIER POSTING

There were some questions about why I wanted to decode FLV files to other formats. On JD on MX. The thing is we use Flash Communication Server to produce flash video from web cams. A lot of times we would like to present this content on other platforms, like on TV, even though the quality is low...

I could of course import it into Flash MX and Export a SWF and the convert it in any of the million of programs that can convert from SWF (I can actually import that file directly in Avid or AE) … But there’s no time for this and I want the Editor to be able to do it himself.

Then Tinic Uro told me about FFmpeg: A command line tool to convert one video file format to another. It’s an open source project and I couldn’t find any binaries for Windows or Mac OSX. I’m not really that deep into "hardcore programming" so I had some help compiling it and running it on Solaris. It felt like there were thousands of Options to mess with and we just couldn’t get them right... conversion failed.

Then I found Riva FLV Encoder that is like a GUI for FFmpeg and LAME (LGPL MP3 encoder). If I rename the file extension to an Extension of my choice, like AVI I’m able to convert the file from FLV to AVI… But only if I have unchecked Enable Audio! With Audio I get:
The encoding of your video file has failed. This can be caused by a not supported combination of parameters or by a not supported video codec.
I have tried different settings but can’t convert the file with sound.

But wait, lets try converting an AVI to FLV and back again... maybe it’s just something wrong or strange with the sound codec in the file created by Flash Com Server. Yes it worked! But oh, it had no sound. Lets try a MPEG with sound... created the FLV fine... coming back... No...

Must and will take time to read some documentation about the format and about FFmpeg. unless someone else can solve my problem...

A file produced by the Flash Com Server can be found here: http://svt.se/content/1/c6/32/35/48/birgitta_intro.flv

«Earlier idtech post on this topic

<link rel='alternate' type='text/html' href='http://idtech.blogspot.com/2005/02/flv-to-other-revisited.html' title='FLV to other... There’s a lot of products that can convert .SWF to any video format and a lot of info about creating .FLV files... For the project I’m working on I don’t have time to import the .FLV’s to flash and export it as .SWF and then convert it.

When asking on Macromedias General Flash forum a guy called urami_ replied:

"There is no any other really because FLV is not any video standard, it's macromedia standard only.
It is to force you continue getting their products for stuff like online streaming , like the COM
SERVER because no other well know technology will support it. Afraid you have no choice."

Discussion: .flv to avi or .mov or .mpeg or ...

Then I thought I hit the jackpot this morning when a colleague of mine emailed me about Canopus Procoder 2.0. The Technical spec said in there Source Formats: Macromedia® Flash™ video to be one of the supported input formats. Yihaa, finally found it I thought and were about to buy it when my Colleague called me up. He had bought it and discovered that it – as usual – only supported .SWF and not .FLV

Doesn’t .FLV to Video converters exist. Doesn’t anyone but me – and my colleague – need this? Is there legal rights etc? that usually never stops developers in the internet community.

Chris Justus - Server Side Guy: Google Suggest Dissected...

Study this!
